Privacy Policy

1.   Definitions
2.   “Le Dolce Sleepwear”
   means Le Dolce Sleepwear (ABN: 76 338 089 452), who will be supplying the Accessory for the Customer to hire.
3.   “Le Dolce Sleepwear Website”
   means Le Dolce Sleepwear’s webpage.  
4.   “Customer”
   means the individual who is hiring out the Accessory supplied by Le Dolce Sleepwear, over the age of 16 and accepts the Term and Conditions (by checking the box that states that the Customer Accepts) of hiring the Accessory.

*for the purposes of this privacy policy, Customer may also mean members of the public browsing Le Dolce Sleepwear’s Website.

1.   “Accessory”
   means all item(s) supplied by Le Dolce Sleepwear to the Customer.
2.   “Agreement of Hire”
   means an agreement that is formed the Customer accepts the Terms and Conditions and makes payment of the Hire Fee. Effectively, Le Dolce Sleepwear will then agree to supply the Accessory to the Customer for the Hire Period.
3.   “Damage(s/d)”
   means any damages including, but not limited to, a stain, mark, tear, discolouration, changes to original colour, faultiness, alterations, caused to the Accessory during the Hire Period, whilst in the possession of the Customer.
4.   “Debt Collectors”
   means any insurer or solicitor/barrister, which Le Dolce Sleepwear has retained to collect any outstanding fees owed the Customer.
5.   “Hire Fee”
   means the cost to hire the Accessory for the Hire Period.
6.   “Hire Period”
   means the duration between the Delivery Date and Return Date of the Accessory.
7.   “Terms and Conditions”
   means the Terms and Conditions which the client agrees to on Le Dolce Sleepwear’s Website when entering an Agreement of Hire.

2.   Personal information collected
3.   All Personal Information collected by Le Dolce Sleepwear will be any information which the Customer has provided to Le Dolce Sleepwear voluntarily. In no circumstance is Personal Information collected by Le Dolce Sleepwear unless the Customer has actively entered and confirmed information onto Le Dolce Sleepwear’s Website.
4.   Personal Information can include, but are not limited to the following:
5.   Identification card such as driver’s license, passport or photo card;
6.   Full name;

      iii.   Date of birth;

1.   Phone number;
2.   Email address;
3.   Postal address; and

      vii.   Payment card details (Mastercard, Visa and Paypal account).

3.   How personal information is collected
4.   A Customer’s Personal Information is only collected when the Customer actively enters and confirms their information onto Le Dolce Sleepwear’s Website through the following methods:
5.   Registration of an account on Le Dolce Sleepwear’s website;
6.   Entering an Agreement of Hire as a registered Customer; and/or

      iii.   Entering an Agreement of Hire as one-off Customer.

     Security, storage and protection of Personal Information
5.   A Customer’s Personal Information will be stored on secured data base.
6.   The data base will have restricted and limited access and will only allow access to Le Dolce Sleepwear and any personnel operating such data base.
7.   A Customer’s account on the Le Dolce Sleepwear Website will be password-protected.
8.   Le Dolce Sleepwear will not be responsible for any privacy breaches that has occurred externally on the Customer’s device, which has caused subsequent breaches on the Customer’s Le Dolce Sleepwear account.
9.   However, should this occur, and Le Dolce Sleepwear is made aware of the issue by the Customer, Le Dolce Sleepwear may at its sole discretion decide to make attempts to assist the Customer such as cancelling any orders that have not been made by the Customer.

5.   Use of Personal Information
6.   Personal Information will be used by only Le Dolce Sleepwear for the following purposes:
7.   To register the Customer’s account onto Le Dolce Sleepwear’s secured data base;
8.   To process an Agreement of Hire and all actions that follow;

      iii.   To assist/respond to any communications with the Customer;

1.   To email and/or SMS the Customer special promotions, updates and newsletters;
2.   To consider any complaints made by the Customer;
3.   To provide to any insurer, debt collector and/or police, as per Clause 6B.

     Release of Personal Information
5.   Le Dolce Sleepwear will release limited Personal Information (name, address and contact details) to Australia Post for the purpose of delivering the Accessory to the Customer after an Agreement of Hire is processed.
6.   A Customer’s Personal Information will be released to Le Dolce Sleepwear’s insurer, debt collector and/or police in the event that the Customer has carried out the following actions:
7.   Failed to return the Accessory because it has been stolen or lost and does not attempt to make payments for the full value of the Accessory as outlined in the Terms and Conditions;
8.   Failed to pay the Penalty Fee as outlined in the Terms and Conditions for damage to the Accessory or late return of the Accessory and does not attempt to make any repayments over the period 6 months or defaults on an agreed payment plan with Le Dolce Sleepwear.
9.   A Customer’s Personal Information will never be sold, made visible or disclosed to a third party/any member of the public or on Le Dolce Sleepwear’s Website.

7.   Period over which Personal Information is stored for
8.   A registered Customer’s Personal Information will be stored until the Customer de-registers their account on the Le Dolce Sleepwear Website. After this, only the name, phone number and email of the Customer’s Personal Information will be kept.

1.   A one-off Customer’s entire Personal Information will be stored until the Accessory is returned by the Return Date, without any damage(s). After this, only the name, phone number and email of the one-off Customer’s Personal Information will be kept.
2.   Whether a Customer is registered or a one-off Customer, the Customer’s entire Personal Information will be stored until any or all owing Penalty Fees or appraised values for the Accessory is repaid to Le Dolce Sleepwear. After this, only the name, phone number and email of the one-off Customer’s Personal Information will be kept.

8.   Cookies
9.   The Customer’s web browser contains cookies which collect amounts of data on the Customers device, if it is an enabled feature in the Customer’s browser settings.
10.   The cookies will not collect or breach the Customer’s Personal Information, however will help Le Dolce Sleepwear identify and track popular features of Le Dolce Sleepwear’s Website.
11.     The purpose of the cookies are to guide and assist Le Dolce Sleepwear with making adjustments and improvements on its website to suit Customer preferences.
12.   The cookies can be disabled through the Customer’s browser settings. Le Dolce Sleepwear’s website will continue to work if the cookies are disabled, however some advanced features may not be available to the Customer.

9.   Opting out
10.   Customers can opt out of emails and/or SMS at any time by following the prompts on their email or Le Dolce Sleepwear’s Website to unsubscribe.
11.   A registered Customer can de-register their account with Le Dolce Sleepwear at any time provided there are no outstanding Penalty Fees or any owing amounts for a stolen or missing Accessory.
12.   A Customer who has de-registered can later re-register an account with Le Dolce Sleepwear again at any time.
13.   Subject to Clause 7, Le Dolce Sleepwear will continue to store registered, de-registered and one-off customers’ name, phone number and email until they unsubscribe by following the prompts on their email or Le Dolce Sleepwear’s Website.

10.   Updating information
11.   A registered Customer may change or update their Personal Information at any time on Le Dolce Sleepwear’s Website.
12.   The old/previous Personal Information will be erased from Le Dolce Sleepwear’s data base, provided there is no conflict of information that would become problematic later on during an Agreement of Hire.
13.   Eg. Identification details have completely changed and it is clear that it is a different person.

11.   Changes to Privacy Policy
12.   This Privacy Policy may be subject to change at any time, and Le Dolce Sleepwear encourages that all Customers read the Privacy Policy from time to time.
13.   Changes the Privacy Policy will be kept at a minimum and Le Dolce Sleepwear will contact all Customers should any significant changes occur.

12.   Le Dolce Sleepwear’s Terms and Conditions
13.   Le Dolce Sleepwear urges all Customers to read this Privacy Policy in conjunction with the Terms and Conditions which are set out on Le Dolce Sleepwear’s Website.
